Shipping policy
1. Purpose and Scope
This Delivery and Shipping Policy sets out the terms under which Bernardette’s Gift Shop provides delivery services to customers purchasing products through its website or authorised sales channels.
By placing an order, customers acknowledge and accept the terms of this Delivery Policy. The Company reserves the right to refuse delivery services where necessary to protect operational integrity or comply with legal obligations.
2. Service Availability
Delivery services are available within Malta and Gozo, subject to operational feasibility, geographic accessibility, and service provider availability.
The Company shall use commercially reasonable efforts to fulfill orders within the estimated timeframes, however, delivery schedules remain indicative only and do not constitute a contractual guarantee.
3. Delivery Timeframes
Estimated delivery periods are as follows:
• Malta: Orders are generally delivered within one (1) to five (5) business days following order confirmation and payment clearance.
• Gozo: Orders are generally delivered within two (2) to seven (7) business days following order confirmation and payment clearance.
Delivery periods may be extended during periods of high demand, public holidays, adverse weather conditions, logistical disruptions, or other circumstances outside the Company’s reasonable control.
4. Delivery Charges
Delivery charges are applied as follows:
- Orders with a total value below €45.00 shall incur a delivery fee of €5.00.
- Orders with a total value of €45.00 or more qualify for free standard delivery.
Delivery charges are calculated per order and will be displayed prior to final order confirmation.
5. Order Processing
Orders will only be processed following receipt of full payment and successful payment authorisation. The Company reserves the right to suspend or cancel orders where payment verification fails or where suspicious activity is detected.
The Company is not responsible for delivery delays caused by incomplete, inaccurate, or incorrectly provided customer information.
6. Inspection Upon Delivery
Customers are required to inspect goods immediately upon delivery, in the presence of the delivery personnel, to confirm that:
- No visible defects, damage, or discrepancies are present
- Items correspond to the order placed
- Goods are received in excellent condition
- No visible defects, damage, or discrepancies are present.
Acceptance of delivery shall constitute confirmation that the goods were received in mint condition, unless damage or defects are reported at the time of delivery. Claims for visible damage reported after delivery acceptance may not be considered.
7. Transfer of Risk and Title
Risk in the goods shall transfer to the customer upon successful delivery and acceptance of the order at the designated delivery address.
The Company shall not be liable for loss, theft, or damage occurring after delivery has been completed and accepted.
Ownership of goods shall remain with the Company until full payment has been received and cleared.
8. Failed Deliveries
The customer is responsible for providing accurate delivery information, including but not limited to:
- Correct delivery address
- Valid contact telephone number
- Accessible delivery location
Where delivery fails due to customer absence, incorrect details, or refusal to accept delivery, additional delivery fees may be charged for subsequent delivery attempts.
9. Force Majeure and Limitations of Liability
The Company shall not be liable for delivery failures, delays, or service interruptions arising from circumstances beyond its reasonable control, including but not limited to:
- Acts of God, including but not limited to: Natural Disasters, Severe Weather, etc.
- Civil Unrest
- Acts of Terror
- Acts of War
- Transport disruptions
- Government restrictions
- Strikes or labour disputes
- Third-party service provider failures
- Other force majeure events
The Company shall not be liable for indirect, consequential, or incidental losses arising from delivery delays.
10. Complaints and Reporting
Any delivery-related complaints must be reported immediately to the Company using the official contact details provided on the website. Delayed reporting may limit the Company’s ability to investigate or resolve delivery issues.
